Waiver & Consent Form

Thank you for enrolling your child in The Creative Lab art classes. We are committed to providing a safe and enriching environment for all participants. Please review this “Parent Waiver and Consent Form” (the “Release”) carefully, as it includes important information about your legal rights and responsibilities.

1. Acknowledgment and Assumption of Risk I the undersigned parent or guardian, enter into this Release in order to allow the below identified child to participate in art classes, workshops and related activities at The Creative Lab and acknowledge and affirm that participation is voluntary with full knowledge that any such activities may involve inherent risks and result in physical injuries, including loss of life arising from, but not limited to: - The use of art supplies, tools, and equipment. - Physical activities or movements involved in creating art. - The potential for accidents or injuries despite supervision. By signing this waiver, I voluntarily assume all risks associated with my child’s participation in these activities with The Creative Lab. I accept full responsibility for any injury or harm that may result therefrom, and agree to release in advance The Creative Lab and all of its owners, employees, agents, and contractors (collectively the “Released Parties”) from any and all liability and waive my/our right, and the right of my/our heirs, to bring legal action (file a claim or lawsuit), to the fullest extent allowed by law, arising out of or connected in any way with my child’s participation regardless of whether that liability arises out of the negligence or carelessness of the Released Parties, even if such negligence or carelessness is the sole cause of the injuries or damages incurred. IN CONSIDERATION OF MY CHILD BEING ALLOWED TO PARTICIPATE IN PROGRAMS WITH THE CREATIVE LAB, I HEREBY WAIVE, RELEASE AND DISCHARGE ANY AND ALL RIGHTS TO MAKE CLAIMS FOR SUCH INJURIES OR DAMAGES which may happen to my child as the result of his/her participation in the activities. FURTHER, I VOLUNTARILY ASSUME ALL RISK, KNOWN AND UNKNOWN, OF INJURIES, HOWEVER CAUSED, EVEN IF CAUSED IN WHOLE OR IN PART OF THE ACTION, INACTION, OR NEGLIGENCE OF THE RELEASED PARTIES.
2. Medical Consent. In the event of a medical emergency, I authorize The Creative Lab staff to seek and obtain medical care for my child if I cannot be reached. I accept full financial responsibility for any medical services provided.
3. Release of Liability I release and hold harmless The Creative Lab, its owners, staff, instructors, and affiliates from any and all claims, demands, or causes of action arising out of or related to my child’s participation in activities at The Creative Lab, except in cases of gross negligence or willful misconduct.
4. Use of Photographs and Videos. I grant The Creative Lab permission to use photographs or videos of my child and their artwork for promotional, educational, and/or marketing purposes in both print, digital and online materials unless I opt out by emailing The Creative Lab at permission@thecreativelabart.com.
5. Behavioral Expectations I understand and agree that my child is required to follow the rules and guidelines set forth by The Creative Lab staff. I acknowledge that disruptive or unsafe behavior may result in my child being removed from the program without notice and without a refund.
6. Refund Policy I understand and agree to The Creative Lab’s refund policy: - Full refund - two weeks prior to the start of camp or class. - 50% Refund - less than two weeks prior to start of camp or class. - No Refund - First day of camp or class and after.
7. Miscellaneous. This Release constitutes the sole and entire agreement of The Creative Lab and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is held invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of The Creative Lab and me and our respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Santa Barbara County, California and I hereby consent to the exclusive jurisdiction of such courts.
8. Agreement to Terms By signing (typing my name below), I confirm that I have read, understood, and agreed to the terms outlined in this Parent Waiver and Consent Form. Further, I certify that I am the legal parent or guardian of the child named above and have the authority to sign this waiver on their behalf so that child may take part in the activities with The Creative Lab.
